New Penalties For DUI Offenses

1. The urine test is not an option when stopped for DUI unless you are suspected of drug influence. Now the choice of chemical test is limited just to breath or blood for regular DUI.
2. If you are convicted of a DUI with a blood alcohol level of .15% or higher you are required to attend a six month DUI program and extra jail time can apply.
3. If you are convicted of a wet-reckless (a plea bargain down from original charge of DUI) you will be required to attend an alcohol program. If you don't enroll in the three month class, no restricted license is possible.
4. If you are convicted of DUI, you must get a 90 day restricted license or lose yours for six months on a first DUI charge, but if you refused the test, it will be worse.
5. As of 9/20/2005, the court can refuse to allow you a restricted license.
